Soneet R. Kapila was appointed Examiner six years after the Plan of Reorganization was confirmed. As a result of concerns expressed by a major creditor, the Court deemed it appropriate to appoint an independent fiduciary to examine the operational conduct of the liquidating trust for compliance with the provisions of the Plan.
